Please read these rules (“Official Rules”) before entering the 2025 Diploma Frame Giveaway (“Promotion”) offered by the University of Massachusetts Amherst Foundation ("we", “our” or "Sponsor"). You agree that, by submitting an entry, you will be bound by these Official Rules, and you acknowledge that you satisfy all Promotion eligibility requirements. The term “you,” or “entrant,” as used in these Official Rules, means any person who submits an entry. The Promotion is subject to all applicable federal, state and local laws. Winning a prize is contingent on fulfilling the requirements set forth in these Official Rules.

DATE OF PROMOTION: The Promotion begins on May 12, at 12:01 a.m. Eastern Time (E.T.) and ends on May 26, 2025 at 11:59 p.m. ET. Sponsor may extend the Promotion period in its sole discretion.

HOW TO ENTER. There are two (2) ways to enter the Promotion:

1. Social Media: To enter, follow UMass Amherst Alumni on or Instagram (@umassalumni), and tag @umassalumni in a photo of your decorated graduation cap between 12:01 a.m. Eastern Time (ET) on May 12, 2025 and 11:59 p.m. ET on May 26, 2025. Your Instagram account settings must be set so that your photo and your account are publicly-viewable.

2. Online Form: You may also enter by filling out the form found at https://forms.gle/RgdatGioShpiXhMC9 between 12:01 a.m. Eastern Time (ET) on May 12, 2025 and 11:59 p.m. ET on May 26, 2025. To enter, you must be a member of the UMass Amherst graduating class of 2025, follow UMass Amherst Alumni on Instagram (@umassalumni) and fill out all fields on the form, including uploading a photo of your decorated graduation cap. Your Instagram account settings must be set so that your account is publicly-viewable.

3. Email: You may also enter by sending an e-mail to socialmedia@uma-foundation.org between 12:01 a.m. Eastern Time (ET) on May 12, 2025 and 11:59 p.m. ET on May 26, 2025, with “2025 Diploma Giveaway” in the subject line and your first name, last name, and phone number in the body of the email.

There is a limit of one (1) entry per person. Multiple entries submitted or completed by anyone other than the entrant shall be void. No mechanical reproductions will be accepted. Entries must contain all entry fields and information outlined above and comply with the requirements outlined above; otherwise, they are void and will not be eligible to win.

Sponsor is not responsible for late, lost, incomplete, corrupted, misdirected entries, or for computer, email, communications, or computer network errors at any point. Use of automated devices or “bots” is prohibited. Promotion entries become the property of Sponsor and will not be returned. You may not enter more than once by using multiple email addresses, identities, or devices in an attempt to circumvent these Official Rules. If you use fraudulent methods or otherwise attempt to circumvent these Official Rules, your submission may be removed from eligibility at the sole discretion of Sponsor.

ELIGIBILITY: This Promotion is open only to legal residents of the fifty (50) United States or the District of Columbia who are eighteen (18) years of age or older as of the date of entry. Entrants must be a verified member of the UMass Amherst graduating Class of 2025 to be eligible. The University of Massachusetts Amherst employees, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and The University of Massachusetts Amherst Foundation affiliates, subsidiaries, advisors and advertising/promotion agencies (and their immediate family members) are not eligible to enter the Promotion. By entering this Promotion, you agree to be bound by these Official Rules and the decisions of Sponsor and/or its agents.

PRIZE: One (1) winner will receive a UMass Amherst diploma frame. One (1) runner up will receive a UMass Amherst swag pack.

TOTAL APPROXIMATE RETAIL VALUE OF THE PRIZE: Value of the UMass Amherst diploma frame is $119.99; approximate value of the UMass Amherst swag pack is $78.99.

No cash or other prize substitution will be permitted except at Sponsor's sole discretion, including Sponsor’s right to substitute a prize of equal or greater value if the advertised prize is unavailable. All prizes are nontransferable. The winner shall be solely responsible for any and all prize-related expenses and fees, including, without limitation, any and all federal, state and/or local taxes (including sales tax). The potential winner shall be responsible, where applicable, to complete and execute an IRS Form 1099, an affidavit of eligibility, and release and waiver liability form in order to receive the prizes, which may require the potential winner to provide his or her Social Security number for purposes of the same, within forty-eight (48) hours of receipt. Subject to verification of eligibility and compliance with these terms and conditions, including verification that the winner is eighteen (18) years of age or older, and a member of the UMass Amherst class of 2025, the potential winner will be declared an official winner of the Promotion. If Sponsor cannot verify that the potential winner is eighteen (18) years of age or older prior to winner notification, then the potential winner will be disqualified and an alternate potential winner will be randomly selected.

The prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

DRAWING AND PRIZE REDEMPTION: One (1) winner and one (1) runner-up will be selected by June 3, 2025, from all eligible entries received. Winners will be determined by a panel of five (5) UMass alumni judges based on predetermined criteria. Limit one prize per person. Awarding of prizes will be conducted by Sponsor, whose decisions are final on all matters relating to the Promotion.

Sponsor will notify the winner by the email account used to enter (for email/form entries) or by direct message to the winner’s social media account used to enter (for social media entries) by June 4, 2025. Winner must respond and acknowledge the prize, and provide information necessary for Sponsor to fulfill the prize. If winner cannot be contacted, is ineligible, fails to claim the prize within 3 days from the time Sponsor sent notification to the winner, the prize may be forfeited, and an alternate winner may be selected. Winners may be required to sign and return an affidavit of eligibility, and release and waiver liability form within the time frame designated by Sponsor. Any prize notification undeliverable will be forfeited and awarded to an alternate winner. Sponsor’s computer will be the official time-keeping device for the Promotion.

ODDS OF WINNING. Odds of winning depend on the number of eligible entries received.

MARKETING LIST AND RELEASE. By entering the Promotion, you consent to being placed on Sponsor’s marketing list for promotional and other material for Sponsor (either by email or by mail) unless you have indicated otherwise by opting out of receiving such promotional material. Each winner agrees that, by participating in the Promotion, Sponsor may use the winner’s name, image or likeness, photograph, voice, biological information, statements and address (city and state) in any manner and in any medium for their promotional purposes without additional compensation, except where prohibited by law, including but not limited through social media. Without limitation of the above, winner may also be tagged by Sponsor in social media posts announcing the winner and featured on Sponsor’s social media “stories.” For details about how your information will be used by Sponsor, please see Sponsor’s Privacy Policy.

ADDITIONAL TERMS: Sponsor may, to the maximum extent permitted by applicable law and in Sponsor’s sole discretion, change these Official Rules or cancel the Promotion at any time; or modify, terminate, or suspend the Promotion should viruses, worms, bugs, unauthorized human intervention or other causes beyond Sponsor’s control corrupt or impair the administration, security, fairness or proper play of the Promotion or submission of entries. Sponsor is not responsible for: (a) lost, misdirected, late, postage due, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Promotion; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer resulting from downloading any materials in connection with the Promotion. Sponsor may, in Sponsor’s sole discretion, disqualify any individual found to be: (x) tampering with the entry process or the operation of the Promotion or website; (y) acting in violation of these Official Rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. The authorized subscriber of the e-mail account used to enter the Promotion at the actual time of entry will be deemed to be the participant and must comply with these Official Rules in the event of a dispute as to entries submitted by multiple users having the same e-mail account. The authorized account subscriber is the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses. No greater than the number of prizes stated in these Official Rules will be awarded. If any technical errors occur in the selection of a potential prize winner or if more prizes are claimed than the number of prizes being awarded as provided in these Official Rules, Sponsor may award the prize by random drawing from among all eligible entrants. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

RELEASE: By participating (a) you release Sponsor, its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, attorneys, and prize suppliers, and each of their respective parent organizations and each such organization’s officers, shareholders, directors, attorneys, members, employees, licensors, and agents (collectively the “Released Parties”), from any and all liability for any claims, costs, injuries, losses, or damages, of any kind caused by your participation, including the unauthorized or illegal access to personal or sensitive information or the acceptance, possession, use, or misuse of the prize; (b) you agree that Released Parties will have no liability whatsoever, and shall be held harmless by you against any liability, for any injuries, losses or damages of any kind, including, but not limited to, death or destruction of property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize(s) (including any travel or activity associated thereto) or participation in this Promotion; and (c) acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty representation or guarantee, expressed or implied, in fact or in law, relative to a prize, including, but not limited to, the prize quality or availability.

LIMITATIONS OF LIABILITY: Neither the Released Parties nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, or any other error or malfunction, or late, lost or misdirected mail or email, or any injury or damage related to or resulting from participation in this Promotion. Neither Released Parties nor any service providers are responsible for typographical or other error in the printing of Promotion materials, the administration of the Promotion, or the announcement of the prize winner, including any such error as may give an erroneous indication that a prize has been won. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.

DISPUTES: The Promotion is governed by the laws of the Commonwealth of Massachusetts, without reference to its conflicts of law rules. You agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal, state and local courts in Boston, Massachusetts (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Commonwealth of Massachusetts, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Massachusetts or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Commonwealth of Massachusetts.

WINNERS LIST: The winner’s first name, last initial, and home city/state will be available after the winner has been notified and the winner’s eligibility confirmed. Requests must be received no later than June 5, 2025.
